Please read the ENTIRE description prior to bidding! You are bidding on my position for a BRAND NEW Ferrari 458 Spider that will be custom ordered to YOUR specifications and delivered late 2012. This super car is one of the most soughtafter cars ever released by Ferrari. This auction has VERY specific terms and conditions which are fully detailed below that by bidding on you accept. Your winning bid is the amount over the MSRP which has been set at $263,762.00 (includes gas guzzler tax) PLUS any options you specify at the time I place your order. There are VERY specific steps, terms and conditions that the winning bidder MUST meet that insures YOUR protection as well as mine. For the right buyer, this is a ZERO RISK transaction as explained in the terms. As this is a brand new to be built car there is no VIN number at this time. The History: I am a current Ferrari owner who placed my deposit for the new 458 Spider several years ago to secure my position for this car. Currently most dealers have fully exhausted their allocation on this vehicle for the next 3 to 4 years. My spot in the allocation is slated to order in the next month with a later August to mid September Delivery estimate. Terms, Conditions & Timeline The following terms and conditions are very structured to provide ZERO RISK to the seller and the winning bidder. If you cannot or are not willing to follow these terms and conditions to the letter please DO NOT BID! Should a bidder have additional questions I would be happy to answer these questions via private contact as long as they in no way compromise the integrity or confidentiality of this sale. 1. The winning bidder shall deposit the amount of the winning bid in the escrow account of a MUTUALLY AGREED UPON ATTORNEY in the state of Ohio along with an additional $50,000 within 3 business days. These funds shall become Non Refundable unless for any reason the seller is not able to deliver the car as ordered by the winning bidder. ALL FUNDS SHALL REMAIN IN ESCROW UNTIL THE VEHICLE IS DELIVERED TO ASSURE THE BUYER NO RISK The winning bidder agrees to sign a confidentiality agreement with the seller. 2. The winning bidder shall within 2 weeks of the auction end place the order with the seller selecting the color and options using the 458 Spider Configurator: http://www.ferrari.com/English/GT_Sport%20Cars/CurrentRange/458_Spider/Pages/458-Spider.aspx A complete list of options and prices are available unsing the link provided. This order shall be forwarded first to escrow attorney mutually selected and then to the seller for placement with the dealer. Once the order is placed no changes can be made. 3. The cost of the escrow attorney will be paid by the buyer and not to exceed $1000.00 4. The seller shall keep the buyer informed of any and all correspondence and information relating to the progress of the production of the 458 Spider as well as intended delivery dates. 5. Within 7 business days of the dealer stated delivery date, the winning bidder shall wire transfer the remaining balance due into the aforementioned mutually agreed upon attorneys escrow account. ALL FUNDS SHALL REMAIN IN ESCROW UNTIL THE VEHICLE IS DELIVERED AND CLEAR TITLE SURRENDERED TO ASSURE THE BUYER NO RISK 6. Upon the receipt of the above described funds, the buyer or his designated agent shall make arrangements to meet the seller on the scheduled delivery date at which time the location of delivery and dealer name shall be disclosed.
