However, as with any vehicle, mechanical or other failures may occur from time to time, and I cannot represent or warranty that they will not. Please note that actual mileage may be slightly higher at the time of the end of the auction and/or delivery due to local test drives, detailing, etc. 2. Bidding on the Vehicle 2.1. Ready to Bid? If you’re ready to bid, great! Please keep in mind a few rules regarding bidding, which follow. 2.2. A Bid Is A Legally Binding Contract. Your bid constitutes a legally binding contract to purchase this vehicle. Please do not bid if you do not intend to, or are not financially able to, complete the purchase of the vehicle. Please have your financial arrangements in place prior to bidding. 2.3. I Don’t Allow Bidders With Negative Feedback. I do not allow bidding from bidders with negative feedback. New bidders with zero feedback should contact me prior to bidding. I reserve the right to obtain and verify the registered information of all users who bid on this auction, and to cancel any and all bids at my discretion. 2.4. I May End An Auction Early. I am a licensed Florida automobile dealer, and some of my vehicles listed on ebay are concurrently offered for sale locally. Call me now if you would like to make an offer. 3. Completing the Transaction 3.1. Contact Me. If you are the winning bidder, congratulations! You must contact me within 24 hours of the end of the auction to make arrangements for the completion of the transaction. My office phone number is 239.738.4440. 3.2. Pay a Deposit. You must pay a non-refundable $500.00 deposit within 24 hours after the end of the auction to secure the vehicle. Please see Section 3.4, below, for payment methods. 3.3. Pay the Balance Due. You must pay the remaining balance due (plus applicable fees and taxes – please see 3.5, below) within 7 days after the end of the auction. 3.4. Payment Methods. I accept cash in person (under $10,000 only), cashier’s checks, wire transfers, or commercial 3rd-party financing. I also accept PayPal for the payment of deposits only. All funds must be in US dollars. 3.5. Fees and Taxes. 3.5.1. Dealer Fee. I charge a $250 dealer fee, which will be added to all transactions. 3.5.2. Sales Tax, Registration & Title Fees. 3.5.2.1. Florida Buyers. You must pay Florida's 6% sales tax plus any local option taxes applicable in your county, and I am required to collect it at the time of the sale. You are also responsible for the cost of Florida title, tag and registration fees, which I collect an estimate of at the time of sale. If the actual cost of title and registration is less than the estimate, I will refund you the difference; if the actual cost is more that the estimate, you will be required to pay the difference. I do not make any money on tax, tag, registration and title fees I collect. 3.5.2.2. Out-of-State Buyers. If you take delivery of the vehicle at my location, I am required to collect all or a portion of the sales tax applicable to motor vehicle sales in your state, i.e., I am required to collect either (i) the actual rate applicable in your state, or (ii) 6%, whichever is less. Generally, you will receive a credit in your state for sales tax collected here (Note: although the vast majority of states have a reciprocal sales tax agreement with Florida, a few do not; please check with your local tag agency.) If your state’s sales tax rate on motor vehicles is greater than 6%, I am required to collect 6% and you will be responsible for paying the difference in your state. If you have the vehicle shipped and take delivery of it outside of Florida, I do not collect sales tax. In that case, you will be responsible for paying the sales tax applicable in your state directly. In any event, you will be responsible for handling the titling and registration of the vehicle in your state and for paying all associated fees and costs. 3.6. Exchange Documents and Signatures. There are, unfortunately, paperwork requirements for completing the transaction, which may vary depending on whether you are from out-of-state or not. These will be discussed when you contact me initially. 3.7. If You Fail to Pay or Communicate with Me. I expect the transaction to go smoothly. However, if you fail to (i) make contact with me, (ii) pay the deposit, (iii) provide me with required signatures/documents, or (iv) pay the remaining balance (including applicable fees, taxes, and charges), within the timeframes set forth herein, I reserve the right to keep your deposit and re-list the vehicle or otherwise sell it as I see fit, without notice, in my sole discretion. I also reserve the right to report the issue to eBay in my sole discretion. 4. Take Delivery of Your New Vehicle 4.1. Completed Transaction. Your vehicle will be available for pick up or shipping once full payment is received and all other paperwork requirements of the transaction are completed. 4.2. Pick Up. I am located at 2645 NE 9th Ave in Cape Coral, Florida. I am easily accessible from US 41 and from Interstate 75. The nearest airport is Southwest Florida Int’l Airport (RSW) in Fort Myers. Here’s a very nice LOW MILE 1983 Mercedes-Benz 240D up for sale. This is a three day NO RESERVE auction. The car will be sold to the highest bidder. If you like this car, bid to win! I have included 80 pictures of the car. If I have missed anything in the pictures or in the description, or if anything is unclear, please ask before bidding. I will happily answer any questions. I often post questions I get - and their corresponding answers - when I think they're a good supplement to the listing, so be sure to check this listing for any Q&As or other additions. If there are any, they will appear at the very bottom of the listing.
The exterior of the car is RUST-FREE and looks great over all. The navy blue paint is new and is very, very shiny. It is not a show-car-quality paint job, and there are some minor blemishes that can be seen upon close inspection, but for a car of its age, this one looks teriffic. The navy blue color looks great on this car as well...most Mercedes of this vintage seem to be some shade of brown, beige or fleshtone...but this car is quite handsome and very shiny. All in all, this is a very sharp looking car as can be seen from the pictures.
The interior of the car is in very good shape as well. First, to get a few items out of the way, the clock, cruise control, central locks, and exterior mirror adjusters don't work, and the trip odometer is broken (though the main odometer works fine). Also, one of the vanity mirrors is broken. It's an almost 30 year old car, after all. That said, for its age, the interior is over all quite good. The MB-Tex upholstery is over all very nice. Up front, just the driver's seat shows only a minimal amount of wear as can be seen in the pictures. The armrest is in great shape. The rear seats are nice as well. The dashboard is likewise in over all good condition with just a few small cracks as can be seen in the pictures. The headliner is good. The power windows all work though the driver's window needs a bit of help staying straight on its way back up. The A/C works, is cold, and comes out the correct vents. The original radio works fine. This car comes with the mats shown, 2 keys, and a factory owner's manual.
This car is fitted with Mercedes's very reliable and extremely efficient 2.4 liter 4-cylinder diesel engine and a 4-speed automatic transmission. You're not going to win any drag races with this car. But what you get is tremendous fuel economy and legendary durability. This car has extremely low miles for a 240D. The miles are believed to be accurate; the title indicates "actual miles" and that is backed up by the Carfax history. The car fires right up and runs well. There's a little bit of play in the steering and drivetrain as you might expect of a car of this age, but all in all, the car runs and drives extremely well. This car just got a new starter. The tires all appear nearly brand new. Drive this car anywhere in style and with incredible efficiency.

1.2. Inspect the Vehicle. I encourage you to inspect the vehicle personally or through an inspection service prior to bidding.
1.3. Be Aware That Vehicles Are Offered As Is/No Warranty Unless Stated. Unless otherwise stated in the vehicle description, the vehicle is being sold “as-is”, with no warranty. I try to accurately and fairly describe any known mechanical or cosmetic issues. However, as with any vehicle, mechanical or other failures may occur from time to time, and I cannot represent or warranty that they will not. You are responsible for any repairs made after the sale.
1.4. Mileage May Vary Slightly. I indicate the mileage of each vehicle at the time of listing. Please note that actual mileage may be slightly higher at the time of the end of the auction and/or delivery due to local test drives, detailing, etc.
2. Bidding on the Vehicle

2.2. A Bid Is A Legally Binding Contract. Your bid constitutes a legally binding contract to purchase this vehicle. Please do not bid if you do not intend to, or are not financially able to, complete the purchase of the vehicle. Please have your financial arrangements in place prior to bidding.

2.4. I May End An Auction Early. I am a licensed Florida automobile dealer, and some of my vehicles listed on ebay are concurrently offered for sale locally. 3. Completing the Transaction
3.1. Contact Me. If you are the winning bidder, congratulations! You must contact me within 24 hours of the end of the auction to make arrangements for the completion of the transaction. My office phone number is 239.738.4440.
3.2. Pay a Deposit. You must pay a non-refundable $500.00 deposit within 24 hours after the end of the auction to secure the vehicle. Please see Section 3.4, below, for payment methods.
3.3. Pay the Balance Due. You must pay the remaining balance due (plus applicable fees and taxes – please see 3.5, below) within 7 days after the end of the auction.
3.4. Payment Methods. I accept cash in person (under $10,000 only), cashier’s checks, wire transfers, or commercial 3rd-party financing. I also accept PayPal for the payment of deposits only. All funds must be in US dollars.
3.5. Fees and Taxes.
3.5.1. Dealer Fee. I charge a $250 dealer fee, which will be added to all transactions.
3.5.2. Sales Tax, Registration & Title Fees.
3.5.2.1. Florida Buyers. You must pay Florida's 6% sales tax plus any local option taxes applicable in your county, and I am required to collect it at the time of the sale. You are also responsible for the cost of Florida title, tag and registration fees, which I collect an estimate of at the time of sale. If the actual cost of title and registration is less than the estimate, I will refund you the difference; if the actual cost is more that the estimate, you will be required to pay the difference. I do not make any money on tax, tag, registration and title fees I collect.
3.5.2.2. Out-of-State Buyers. If you take delivery of the vehicle at my location, I am required to collect all or a portion of the sales tax applicable to motor vehicle sales in your state, i.e., I am required to collect either (i) the actual rate applicable in your state, or (ii) 6%, whichever is less. Generally, you will receive a credit in your state for sales tax collected here (Note: although the vast majority of states have a reciprocal sales tax agreement with Florida, a few do not; please check with your local tag agency.) If your state’s sales tax rate on motor vehicles is greater than 6%, I am required to collect 6% and you will be responsible for paying the difference in your state. If you have the vehicle shipped and take delivery of it outside of Florida, I do not collect sales tax. In that case, you will be responsible for paying the sales tax applicable in your state directly. In any event, you will be responsible for handling the titling and registration of the vehicle in your state and for paying all associated fees and costs.
3.6. Exchange Documents and Signatures. There are, unfortunately, paperwork requirements for completing the transaction, which may vary depending on whether you are from out-of-state or not. These will be discussed when you contact me initially.
3.7. If You Fail to Pay or Communicate with Me. I expect the transaction to go smoothly. However, if you fail to (i) make contact with me, (ii) pay the deposit, (iii) provide me with required signatures/documents, or (iv) pay the remaining balance (including applicable fees, taxes, and charges), within the timeframes set forth herein, I reserve the right to keep your deposit and re-list the vehicle or otherwise sell it as I see fit, without notice, in my sole discretion. I also reserve the right to report the issue to eBay in my sole discretion.
4. Take Delivery of Your New Vehicle
4.1. Completed Transaction. Your vehicle will be available for pick up or shipping once full payment is received and all other paperwork requirements of the transaction are completed.
4.2. Pick Up. I am located at 2645 NE 9th Ave in Cape Coral, Florida. I am easily accessible from US 41 and from Interstate 75. The nearest airport is Southwest Florida Int’l Airport (RSW) in Fort Myers. Please contact me to make arrangements if you are planning to pick the vehicle up. I can arrange to meet you at RSW and bring you to my location.
4.3. Shipping. I will happily assist you in finding a shipping company. However, you will be responsible for all arrangements and all costs of shipping. I assume no responsibility for damage to the vehicle incurred after it leaves my premises.
