I encourage you to inspect the vehicle personally or through an inspection service prior to bidding. 1.3. Be Aware That Vehicles Are Offered As Is/No Warranty Unless Stated. Unless otherwise stated in the vehicle description, the vehicle is being sold “as-is”, with no warranty. I try to accurately and fairly describe any known mechanical or cosmetic issues. However, as with any vehicle, mechanical or other failures may occur from time to time, and I cannot represent or warranty that they will not. You are responsible for any repairs made after the sale. 1.4. Mileage May Vary Slightly. I indicate the mileage of each vehicle at the time of listing. Please note that actual mileage may be slightly higher at the time of the end of the auction and/or delivery due to local test drives, detailing, etc. 2. Bidding on the Vehicle 2.1. Ready to Bid? If you’re ready to bid, great! Please keep in mind a few rules regarding bidding, which follow. 2.2. A Bid Is A Legally Binding Contract. Your bid constitutes a legally binding contract to purchase this vehicle. Please do not bid if you do not intend to, or are not financially able to, complete the purchase of the vehicle. Please have your financial arrangements in place prior to bidding. 2.3. I Don’t Allow Bidders With Negative Feedback. I do not allow bidding from bidders with negative feedback. New bidders with zero feedback should contact me prior to bidding. I reserve the right to obtain and verify the registered information of all users who bid on this auction, and to cancel any and all bids at my discretion. 2.4. I May End An Auction Early. I am a licensed Florida automobile dealer, and all of my vehicles are concurrently offered for sale locally. I reserve the right to end this auction without notice at any time if the vehicle is no longer available, or for any other reason in my sole discretion. Don’t let this vehicle get away! Call me now if you would like to make an offer. 3. Completing the Transaction 3.1. Contact Me. If you are the winning bidder, congratulations! You must contact me within 24 hours of the end of the auction to make arrangements for the completion of the transaction. My office phone number is 239.738.4440. 3.2. Pay a Deposit. You must pay a non-refundable $500.00 deposit within 24 hours after the end of the auction to secure the vehicle. Please see Section 3.4, below, for payment methods. 3.3. Pay the Balance Due. You must pay the remaining balance due (plus applicable fees and taxes – please see 3.5, below) within 7 days after the end of the auction. 3.4. Payment Methods. I accept cash in person (under $10,000 only), cashier’s checks, wire transfers, or commercial 3rd-party financing. I also accept PayPal for the payment of deposits only. All funds must be in US dollars. 3.5. Fees and Taxes. 3.5.1. Dealer Fee. I charge a $250 dealer fee, which will be added to all transactions. 3.5.2. Sales Tax, Registration & Title Fees. 3.5.2.1. Florida Buyers. You must pay Florida's 6% sales tax plus any local option taxes applicable in your county, and I am required to collect it at the time of the sale. You are also responsible for the cost of Florida title, tag and registration fees, which I collect an estimate of at the time of sale. If the actual cost of title and registration is less than the estimate, I will refund you the difference; if the actual cost is more that the estimate, you will be required to pay the difference. I do not make any money on tax, tag, registration and title fees I collect. 3.5.2.2. Out-of-State Buyers. If you take delivery of the vehicle at my location, I am required to collect all or a portion of the sales tax applicable to motor vehicle sales in your state, i.e., I am required to collect either (i) the actual rate applicable in your state, or (ii) 6%, whichever is less. Generally, you will receive a credit in your state for sales tax collected here (Note: although the vast majority of states have a reciprocal sales tax agreement with Florida, a few do not; please check with your local tag agency.) If your state’s sales tax rate on motor vehicles is greater than 6%, I am required to collect 6% and you will be responsible for paying the difference in your state. If you have the vehicle shipped and take delivery of it outside of Florida, I do not collect sales tax. In that case, you will be responsible for paying the sales tax applicable in your state directly. In any event, you will be responsible for handling the titling and registration of the vehicle in your state and for paying all associated fees and costs. 3.6. Exchange Documents and Signatures. There are, unfortunately, paperwork requirements for completing the transaction, which may vary depending on whether you are from out-of-state or not. These will be discussed when you contact me initially. 3.7. If You Fail to Pay or Communicate with Me. I expect the transaction to go smoothly. However, if you fail to (i) make contact with me, (ii) pay the deposit, (iii) provide me with required signatures/documents, or (iv) pay the remaining balance (including applicable fees, taxes, and charges), within the timeframes set forth herein, I reserve the right to keep your deposit and re-list the vehicle or otherwise sell it as I see fit, without notice, in my sole discretion. I also reserve the right to report the issue to eBay in my sole discretion. 4. Take Delivery of Your New Vehicle 4.1. Completed Transaction. Your vehicle will be available for pick up or shipping once full payment is received and all other paperwork requirements of the transaction are completed. 4.2. Pick Up. I am located at 2645 NE 9th Ave in Cape Coral, Florida. I am easily accessible from US 41 and from Interstate 75. The nearest airport is Southwest Florida Int’l Airport (RSW) in Fort Myers. Please contact me to make arrangements if you are planning to pick the vehicle up. I can arrange to meet you at RSW and bring you to my location. 4.3. Shipping. I will happily assist you in finding a shipping company. However, you will be responsible for all arrangements and all costs of shipping. Here is a nice 1994 BMW 325i Convertible up for sale. This is overall a nice little car, but it does have a mechanical issue so please read the entire description before bidding! It is being sold strictly as-is, no warranty. There's no "Buy It Now" price on this one...this is a NO RESERVE auction...the car will be sold to the highest bidder. I try to give as thorough a description of the good and bad points as possible. If I have missed anything, or anything is unclear, please ask before bidding.
I'm calling the color Gulf of Mexico Blue (it's an attractive turquoise metallic). The paint is in good condition. The body is straight. There are a few decent sized dings on the driver's door (no paint damage) as you might expect on a 1994 car. Also, one of the foglights is missing (see pictures), but I'm including a replacement light (new-in-box) with the car (again, see pictures). All in all, the car looks great.
The power convertible top is in overall good condition. The plastic rear window is clear and in good shape. The cloth likewise is generally in good condition, except for a small seam separation on both rear corners (pictured). I have had this car in heavy rain and have not observed any leaks. The power operation works as it should, except that I have found the stowage cover needs a little bit of manual help to prevent it bumping into the bottom of the top at a particular point in the process of putting the top down. But it goes down fine and the car is a joy to drive with the top down.
The interior of the car is tan leather and is in good condition. The upholstry is in good shape. The A/C is cold. The heat seemed weak to me, but it has heated seats to help on those cold days. All of the instruments work properly. The car has power windows, including a single button that controls all 4 windows at once. Two negative items to note in the interior: the brake light warning occasionally comes on although all of the brake lights seem to be working properly; may be a loose bulb that sets it off? Also, very, very few of the power seat functions work on both the driver and passenger seats.
The car has BMW's famous 2.5 liter straight 6 cylinder engine and an automatic transmission. The motor runs great. The transmission likewise goes through the gears as it should. However, I noticed that the torque converter doesn't always lock up in top gear like it should. The problem would never be noticed in regular around-town driving - I had put 300 miles on the car before I noticed the issue. The torque converter should lock over about 55 MPH - it works fine when the car is cold but when it warms up, the torque converter will not stay locked. It can be provoked into locking with light or moderate acceleration over 55 MPH, but it will unlock again if you level out to maintain a constant speed. The practical effect is a couple hundred more RPMs than it needs to be turning at highway speed. The issue is not noticeable in regular around-town driving. Many drivers would never notice at all. But I have done my best to describe the symptoms I noticed. The car is nonetheless alot of fun to drive. It can be driven and enjoyed.

1. Before You Bid
1.1. Read the Vehicle Description and Ask Questions. Every effort is made to accurately and fairly describe the vehicles I offer. If you have a specific question or concern, please ask. Please also keep in mind that this is a pre-owned vehicle. As with any pre-owned vehicle, minor cosmetic flaws may be visible under close inspection.
1.2. Inspect the Vehicle. I encourage you to inspect the vehicle personally or through an inspection service prior to bidding.
1.3. Be Aware That Vehicles Are Offered As Is/No Warranty Unless Stated. Unless otherwise stated in the vehicle description, the vehicle is being sold “as-is”, with no warranty. I try to accurately and fairly describe any known mechanical or cosmetic issues. However, as with any vehicle, mechanical or other failures may occur from time to time, and I cannot represent or warranty that they will not. You are responsible for any repairs made after the sale.
1.4. Mileage May Vary Slightly. I indicate the mileage of each vehicle at the time of listing. Please note that actual mileage may be slightly higher at the time of the end of the auction and/or delivery due to local test drives, detailing, etc.
2. Bidding on the Vehicle
2.1. Ready to Bid? If you’re ready to bid, great! Please keep in mind a few rules regarding bidding, which follow.
2.2. A Bid Is A Legally Binding Contract. Your bid constitutes a legally binding contract to purchase this vehicle. Please do not bid if you do not intend to, or are not financially able to, complete the purchase of the vehicle. Please have your financial arrangements in place prior to bidding.
2.3. I Don’t Allow Bidders With Negative Feedback. I do not allow bidding from bidders with negative feedback. New bidders with zero feedback should contact me prior to bidding. I reserve the right to obtain and verify the registered information of all users who bid on this auction, and to cancel any and all bids at my discretion.
2.4. I May End An Auction Early. I am a licensed Florida automobile dealer, and all of my vehicles are concurrently offered for sale locally. I reserve the right to end this auction without notice at any time if the vehicle is no longer available, or for any other reason in my sole discretion. Don’t let this vehicle get away! 3. Completing the Transaction
3.1. Contact Me. If you are the winning bidder, congratulations! You must contact me within 24 hours of the end of the auction to make arrangements for the completion of the transaction. My office phone number is 239.738.4440.
3.2. Pay a Deposit. You must pay a non-refundable $500.00 deposit within 24 hours after the end of the auction to secure the vehicle. Please see Section 3.4, below, for payment methods.
3.3. Pay the Balance Due. You must pay the remaining balance due (plus applicable fees and taxes – please see 3.5, below) within 7 days after the end of the auction.
3.4. Payment Methods. I accept cash in person (under $10,000 only), cashier’s checks, wire transfers, or commercial 3rd-party financing. I also accept PayPal for the payment of deposits only. All funds must be in US dollars.
3.5. Fees and Taxes.
3.5.1. Dealer Fee. I charge a $250 dealer fee, which will be added to all transactions.
3.5.2. Sales Tax, Registration & Title Fees.
3.5.2.1. Florida Buyers. You must pay Florida's 6% sales tax plus any local option taxes applicable in your county, and I am required to collect it at the time of the sale. You are also responsible for the cost of Florida title, tag and registration fees, which I collect an estimate of at the time of sale. If the actual cost of title and registration is less than the estimate, I will refund you the difference; if the actual cost is more that the estimate, you will be required to pay the difference. I do not make any money on tax, tag, registration and title fees I collect.
3.5.2.2. Out-of-State Buyers. If you take delivery of the vehicle at my location, I am required to collect all or a portion of the sales tax applicable to motor vehicle sales in your state, i.e., I am required to collect either (i) the actual rate applicable in your state, or (ii) 6%, whichever is less. Generally, you will receive a credit in your state for sales tax collected here (Note: although the vast majority of states have a reciprocal sales tax agreement with Florida, a few do not; please check with your local tag agency.) If your state’s sales tax rate on motor vehicles is greater than 6%, I am required to collect 6% and you will be responsible for paying the difference in your state. If you have the vehicle shipped and take delivery of it outside of Florida, I do not collect sales tax. In that case, you will be responsible for paying the sales tax applicable in your state directly. In any event, you will be responsible for handling the titling and registration of the vehicle in your state and for paying all associated fees and costs.
3.6. Exchange Documents and Signatures. There are, unfortunately, paperwork requirements for completing the transaction, which may vary depending on whether you are from out-of-state or not. These will be discussed when you contact me initially.
3.7. If You Fail to Pay or Communicate with Me. I expect the transaction to go smoothly. However, if you fail to (i) make contact with me, (ii) pay the deposit, (iii) provide me with required signatures/documents, or (iv) pay the remaining balance (including applicable fees, taxes, and charges), within the timeframes set forth herein, I reserve the right to keep your deposit and re-list the vehicle or otherwise sell it as I see fit, without notice, in my sole discretion. I also reserve the right to report the issue to eBay in my sole discretion.
4. Take Delivery of Your New Vehicle
4.1. Completed Transaction. Your vehicle will be available for pick up or shipping once full payment is received and all other paperwork requirements of the transaction are completed.
4.2. Pick Up. I am located at 2645 NE 9th Ave in Cape Coral, Florida. I am easily accessible from US 41 and from Interstate 75. The nearest airport is Southwest Florida Int’l Airport (RSW) in Fort Myers. Please contact me to make arrangements if you are planning to pick the vehicle up. I can arrange to meet you at RSW and bring you to my location.
4.3. Shipping. I will happily assist you in finding a shipping company. However, you will be responsible for all arrangements and all costs of shipping. I assume no responsibility for damage to the vehicle incurred after it leaves my premises.
