T E R M S A N D C O N D I T I O N S O F S A L E The Seller: For purpose of this sale, the term "Seller" is the party offering the vehicle for sell and may or may not be named on the vehicle's title as the vehicle's owner. Placing A Deposit For The Item's Purchase: The winning bidder (the Buyer), or second chance Buyer MUST: 1) Make a required $250.00 deposit to the Seller using the item's Paypal link located within the vehicle's listing WITHIN TWENTY-FOUR (24) HOURS OF THE AUCTION'S END which must clear, both, the Seller's Paypal account and bank account within _7_ days from the auction's end, AND 2.) Give the Seller the Buyer's contact information (i.e., full name, address, and a working phone number) using e-bay's "MESSAGES" which can be accessed through the item's "Contact Seller" link located within the item's listing. NOTE: 1.) Upon the Buyer's Paypal deposit clearing, both, the Seller's Paypal and checking account account within 7 days of the auction’s end, the Seller will use the Buyer's contact information (see above) to contact the Buyer to make final payment and delivery arrangements. 2.) Buyers who do not make the required deposit within the time frame specified above will be reported to Ebay. 3.) To protect the Seller from Buyers desiring to defraud Ebay (e.g., suggesting to complete the sale outside of e-bay, etc…), the Buyer should not expect the Seller to communicate with the Buyer until AFTER the Buyer’s deposit clears, both, Seller’s Paypal and checking accounts. Therefore, other than the Seller acknowledging that the Seller has received the Buyers Paypal deposit, the Buyer should not expect that the Seller will communicate with the Buyer, in any manner, until the Buyer’s deposit clears, both, Seller’s Paypal and checking accounts. Full Payment of Balance Due: The "Full Payment of Balance Due" is due and must be paid upon the Buyer's Paypal deposit clearing, both, the Seller's Paypal and checking account no more than _7_ days of the auction’s end; paid in person in cash. Delivery: Provided, both, the Buyer's Paypal deposit and the Buyer's "Full Payment of Balance Due" is paid in person in cash shall the Seller make the vehicle available, its keys, or its title available to the Buyer; whereby the Buyer hereby agrees to take immediate delivery of the vehicle. Storage Fee: In addition to all other amounts the Buyer may owe the Seller, the Buyer shall incur and pay the Seller a $50.00 per day charge at the time of delivery for any and all days the vehicle remains with the Seller after the "Full Payment of Balance Due" date (7 days after the auction's end); regardless if the Buyer satisfies either the required deposit or the "Full Payment of Balance Due", or takes delivery of the item then later returns it for any reason. Furthermore, in the event that the Buyer fails to satisfy this paragraph, the Buyer agrees that the Seller, without notice, may tow and impound the vehicle at the Buyer's expense. Odometer Readings: Due to demo test drives and mechanical inspections, the mileage stated within the vehicle's listing may be different than the item's actual mileage at the time of delivery; and, such mileage may or may not be the item's actual mileage. Buyer's Inspection: It is up to the Buyer to make themselves available to look at and inspect the vehicle to fully satisfy themselves with the vehicles condition prior making any bid. Prospective Buyer's may look at and inspect the vehicle prior to making a bid or agreeing to pay any price for the vehicle no less than 48 hours prior to the end of the auction. NOTE TO BIDDERS: You are bidding to buy this vehicle—not to come take a look at it or inspect it, as it is the responsibility of the Buyer to have thoroughly inspected the vehicle and to have satisfied themselves as to the condition and value of the item PRIOR to bidding on the item and to bid based upon their own judgment alone. Emissions: The Buyer understands that the Seller does not guarantee that the vehicle will comply with any federal and/or state emission laws. Shipping & Transportation: Buyer understands that the Buyer is responsible for any and all shipping and transportation charges related to the sale of this vehicle. Seller's Right To Cancel Bids: The Seller reserves the right to, without notice nor reason, end or cancel this auction for this item at anytime (i.e., before, during, or after the auction.); to cancel any one or all bids for the item, or cancel any sale for the item. Legal Dispute: In the event of a dispute or legal dispute, the Buyer hereby agrees not to bring any type of suit against Ebay or any of its users, Paypal or any of its users, nor the Seller for any reason. Furthermore, the Buyer agrees that should the Buyer file a legal suit, such suit shall be filed and resolved by a Maryland Court of Law, filed in Prince Georges County.
