The term “vehicle(s)” shall mean all items posted for sale, including but not limited to cars, trucks, motorcycles, etc. Seller expressly disclaim the accuracy or completeness of any and all information provided to Buyers regarding vehicles, whether provided in written, verbal, or digital image form ("Vehicle Description"). Vehicle Information provided by seller is for convenience only. Buyers shall not rely on Vehicle Information or digital images in deciding whether or how much to bid on a vehicle offered for sale through Seller. Vehicle Information includes but is not limited to: year, make, model, condition, damage amount, damage type, damage description, drivability, accessories, mileage, odometer disclosures, title, repair cost, repair history, title history, and total loss history. Seller expressly disclaim any and all representations, warranties, and guarantees regarding vehicles and other item offered for sale. Seller does not guarantee that keys are or will be available for any vehicle sold, regardless of whether keys are/were present in online vehicle images, or were present in the vehicle prior to the time of purchase. Parts may be missing. Seller does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Buyer to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles. All Buyers agree that Seller vehicles are sold AS IS and are not represented as being in a road worthy condition, mechanically sound, or maintained at any guaranteed level of quality. The vehicles may not be fit for use as a means of transportation and may require substantial repairs and or expense. Seller does not guarantee that any vehicle sold can be legally registered in any state or country, and Buyer accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that may negatively impact the marketability of vehicles purchased from Seller. (For example, a vehicle legally purchased on a clean title by a Buyer located in State "A" may be required to be sold on a salvage title if Buyer transports and resells the vehicle in State “B".) Seller is not responsible for defects, errors, or omissions (i) related to motor vehicle department or department of revenue paperwork or (ii) made by DMV/MVD/DOR. Vehicles listed for sale may have been reported to the National Motor Vehicle Title Information System (NMVTIS). Buyer accepts all risks associated with purchasing vehicles from Seller resulting from the reporting of the vehicle to NMVTIS by Seller or others. Seller reserves the right to reject or void bids for any reason, in Seller's sole and absolute discretion. Should a dispute arise regarding a bid, Buyer agrees that Seller will be the exclusive deciding authority with sole and absolute discretion in resolving disputes. Buyers agree to indemnify, defend, and hold Seller harmless from any and all liability arising out of decisions made in resolving disputes. Seller may, in its sole and absolute discretion and with or without notice, postpone or cancel a sale or withdraw a vehicle from a sale. Seller will neither have liability nor obligation to Buyers as a result of any vehicle withdrawal, or sale cancellation or postponement. Vehicles are in the seller’s possession at the time of bidding and may only be inspected using the images available or in person by the potential buyer himself. In order for the seller to make the vehicle available to be inspected by anyone else besides the direct buyer, seller will attach a $500 convince fee to the total winning bid on the vehicle that must be paid via Paypal upon seller request. Once submitted, bids can be increased, but cannot be lowered or retracted. If a Buyer's bid has been accepted, the Buyer is obligated to purchase the vehicle. Seller is not required to notify the the Buyer directly, It is the sole responsibility of the buyer to check their email for auction notifications regarding their bid status on the sellers item. The Buyer will have 5 days allowed to pick up the vehicle before late-payment fee and storage fees apply. If prior to the vehicle being removed from Seller premises, it is determined that items have been removed or replaced on the vehicle, that additional damage has occurred since the time the Buyer submitted his/her bid, and/or there is a title type discrepancy, the Buyer will have the option to purchase the vehicle at the original price or cancel the sale which will result in the loss of any deposits made to the seller. Odometer readings that differ from the listed mileage by less than 5,000 miles do not qualify for transaction cancellation. Seller reserves the right not to release any vehicle title for any reason. If seller decides to issue a vehicle title to buyer, buyer acknowledges that it may take up to 120 business days for title to be issued and may take up to 14 days to be delivered after issue date from seller. Once a bid has been submitted it will not be cancelled. Buyer takes full responsibility and assumes all risk of loss for all vehicles purchased from the exact time of day Seller accepts Buyer’s bid. From and after acceptance of Buyer’s bid, Buyer acknowledges that Seller is acting as bailee of Buyer’s vehicle until such time as the vehicle is removed from Seller’s premises and/or possession. Buyer agrees that under the terms of the bailment, Seller shall not be responsible for damage to or loss of the vehicle or parts thereof due to operational procedures in place at Seller location, from acts of theft or vandalism, or acts of God; or weather. Seller shall only be responsible for damage to or loss of the vehicle or parts thereof caused by the direct willful or grossly negligent act or omission of Seller; and Seller shall not be responsible for any claim of damage made after the vehicle has left Seller’s premises, regardless of whether Buyer, or any person on Buyer’s behalf such as Buyer’s agents, employees, or representatives, or tow drivers, pick up the vehicle. Once a vehicle is removed from Seller’s premises it is accepted AS-IS, and under no circumstances will Seller be liable for subsequent claims of damage or loss of any kind or nature whatsoever. In the event Seller is responsible, damages shall be limited to the lesser of (i) the amount of the diminution in value of the vehicle as reasonably estimated by Seller, or (ii) the purchase price (in which case buyer shall return/ship the vehicle back to the seller at buyers own cost). Seller may, in its sole discretion decide upon arrival back to sellers original pickup location , make a decision to resell the vehicle by whatever means the seller decides and have 180 days to do so. The difference between the original sale price to buyer and the resale price shall be conclusive as to the amount of diminution of value, if any at all. It is the responsibility of the Buyer to comply with any customs or import procedures applicable to foreign title vehicles. Customs inspection, import fees and proof of emissions compliance may be required. If needed, the potential buyer my request a copy of all the the terms listed above be emailed to him/her. Please allow 14 days for seller to fulfill the request.THE PREVIOUS DISCLAIMER WAS PLACED HERE FOR MY PROTECTION. IT HAS BEEN MY PERSONAL EXPERIENCE IN THE PAST THAT EBAY AS A COMPANY DOES NOT STAND BEHIND OR PROTECT THIER SELLERS (IN MY OPINION) FROM FRAUDULENT CLAIMS, FROM FRAUDULENT BUYERS, NON-PAYING BIDDERS ETC. SO EVEN THOUGH MANY OF THE FACTS STATED IN THE DISCLAIMER MY NEVER APPLY TO ANY ITEM OR VEHICLE I MAY LIST FOR SALE AFTER ITS PURCHASE, IT STILL MUST BE POSTED FOR MY PERSONAL PROTECTION AS A SELLER ON EBAY.
