Read the Vehicle Description and Ask Questions. I spend a lot of time creating my listings, and I make every effort to thoroughly, accurately and fairly describe the vehicles I offer. If you have a specific question or concern, or if I missed something, please feel free to ask. Please keep in mind that I sell pre-owned vehicles. As with any pre-owned vehicle, minor cosmetic flaws may be visible under close inspection.1.2. Inspect the Vehicle. I encourage you to inspect the vehicle personally or through an inspection service prior to bidding. If you would like to inspect the vehicle, please call to make arrangements. 1.3. Be Aware That Vehicles Are Offered As Is/No Warranty Unless Stated. Unless otherwise stated in the vehicle description, the vehicle is being sold “as-is”, with no warranty. I try to accurately and fairly describe any known mechanical or cosmetic issues. However, as with any vehicle, mechanical or other failures may occur from time to time, and I cannot represent or warranty that they will not. You are responsible for any repairs made after the sale. 1.4. Mileage May Vary Slightly. I indicate the mileage of each vehicle at the time of listing. Please note that actual mileage may be slightly higher at the time of the end of the auction and/or delivery as the vehicle may be driven while the auction is underway. 2. Bidding on the Vehicle2.1. Please keep in mind a few requirements and courtesies. Please intend to, and be ready & able to (financially and otherwise), complete the purchase of the vehicle within the timeframes set out herein. Participating without the intention to complete the transaction is unfair to me the seller and to other bidders who may want the vehicle. It also wastes a lot of time and money. I may obtain the registered information of users participating in my auctions, and may filter or cancel any bids at my discretion.2.2. End An Auction Early. "Buy it now" auctions may end at any time if the buy it now feature is exercised or a "best offer" is accepted. I seldom end my auctions early. However, I reserve the right to end any auction without notice at any time for any reason in my sole discretion. 3. Completing the Transaction3.1. Contact Me. If you are the winning bidder, congratulations! You must contact me within 24 hours of the end of the auction to make arrangements for the completion of the transaction. Many of my auctions end well after normal business hours, so sending me a message through eBay is generally the best way. 3.2. Pay a Deposit. You must also pay a $500.00 deposit via PayPal within 24 hours after the end of the auction to secure the vehicle.3.3. Pay the Balance Due. You must pay the remaining balance due (plus applicable fees and taxes – please see 3.5, below) within 3 days after the end of the auction. Failure to pay the remaining balance within the stipulated time will cancel the transaction and deposit paid is forfeited. 3.4. Payment Methods. I accept wire transfers, cashier's checks, and cash in person (under $10,000 only). I accept PayPal for the payment of deposits only. All funds must be in US dollars.3.5. Fees and Taxes.3.5.1. Dealer Fee. I charge a $100 dealer fee, which will be added to all transactions. This includes winning bids, buy it now prices, and best offers accepted. No exceptions will be made.3.5.2. Sales Tax.3.5.2.1. Georgia Buyers. I am required to GA Title Ad Valorem Tax (TAVT) which is currently set at 6.5% of the fair market value of the car based on the year , make and model as determined by the GA DOR. Please visit http://onlinemvd.dor.ga.gov/Tap/Option1.aspx#message for more information. 3.5.2.2. Out-of-State Buyers. Out of state buyers are not required to pay GA taxes. You will be responsible for paying your state's sales tax directly. 3.5.3. Tag & Title.3.5.3.1. Georgia Buyers. I am required by law to handle your title work. Title work cannot be done in GA without payment of TAVT as specified above. Therefore, GA buyers will not be handed the title as was previously the practice. I will handle all the title work and the GA DMV will mail you a title in your name. You will be provided with a GA temporary registration valid for 30 days while the title work is being done.3.5.3.2. Out-of-State Buyers. I will provide you with the vehicle's title if available at the time of sale. Most vehicles I sell have the title ready at the time of sale. In some cases, the title may be in transit or not ready. You are however guaranteed a clean and clear title within 21days of the sale. You will be responsible for handling the tag and title work in your state.3.6. Exchange Documents and Signatures. There are, unfortunately, paperwork requirements for completing the transaction, which vary depending on whether you are from out-of-state or not. These will be discussed when you contact me initially. 3.7. If You Fail to Pay or Communicate with Me. I expect the transaction to go smoothly. However, if you fail to (i) make contact with me, (ii) pay the deposit, (iii) provide me with required signatures/documents, or (iv) pay the remaining balance (including applicable fees, taxes, and charges), within the timeframes set forth herein, I reserve the right to keep your deposit and re-list the vehicle or otherwise sell it as I see fit, without notice, at my sole discretion. I also reserve the right to report the issue to eBay as I deem fit. 4. Take Delivery of Your New Vehicle4.1. Shipping. It is frequently less expensive to have a vehicle shipped to your location than it is to fly in and drive it back, and certainly more hassle-free. I can assist you in finding a shipper and can get very competitive shipping quotes. You pay the shipper directly and are responsible for delivery arrangements. I assume no responsibility for damage to the vehicle incurred after it leaves my premises. Your vehicle will be available to ship out once full payment is received and has cleared; I send out titles once payment has cleared and all other paperwork requirements of the transaction are completed. Please note: Buyers and/or their shippers van take delivery of vehicles on FRI, SAT & SUN only except by prior arrangement. 4.2. Pick Up. ITEM DESCRIPTION:

MILEAGE

The mileage on the odometer reads 122,835 miles. However, this is not the correct mileage. The ABS unit has a fault and therefore, the speedometer and odometer do not work. The last recorded mileage according GA emissions test certificate was 120,568 on 11/05/2014. I believe the correct mileage should be about 130k miles give or take a few.

This car has current GA emissions valid until 11/04/2015.

POWER TRAIN

This vehicle starts first time and idles smoothly. It runs and drives well. The transmission engages smoothly also. It has been road tested in city traffic and at highway speeds up to 80 mph. This car has NOT been inspected by a qualified mechanic and may therefore have defects that are were evident during the road test.

NOTE:

The ABS unit in this car is defective and therefore the speedometer and odometer do not currently work. I swapped ABS units with another BMW I have and the odometer and speedometer worked. (I have since removed the swapped ABS unit)

The buyer will need to replace the ABS unit with a new or used one and get the BMW dealer to recode the car. If the car is not recoded, the speedometer and odometer will work but the ABS /DSC/BRAKE lights will not go off.

The CHECK ENGINE LIGHT is on. The code is p0100 which indicates faultly MASS AIRFLOW METER(s) (MAF). This car has 2 MAFS and the buyer may need to replace both. This causes the car to jerk at engine speeds above 2800 rpm. When driven below 2800 rpm, it drives smoothly. Because it is a 12 cylinder car, you seldom need to go above 2800 rpm when driving at normal speeds both in town and on the highway.

EXTERIOR

The body of the car is average. No major dents or scratches noticeable.

NOTE:

· The hood appears to have been repainted

· The paint on the roof and trunk is faded and should be repainted.

The driver’s seat leather is worn

Drivers door panel is worn

Emergency indicator button is loose

The car has 1 remote/key combo. The remote key does not work.

• Has 4 decent tires with about 50% tread left

• Brakes Work Well But Have Not Been Inspected
