Terms of Sale and Auction We reserve the right to cancel all bids and end any auction early if a vehicle is sold on any of our lots. All vehicles sell rather quickly so feel free to make us an offer. 1.- All bidders, must be over 18 years of age and have 95% positive feedback. If there are any questions, call before bidding. Any bidder with less than one positive feedback and less than 95% positive feedback may have their bid cancelled. 2.- Bidding Rules: When a bid is placed it becomes a legally binding contract to purchase the vehicle or item listed. Do not bid if you have no intention of buying. If necessary, legal jurisdiction is Grant County, Indiana. No rebates or other incentives will apply to this auction. A bid may not be retracted within 12 hour period of the close of an auction. You will be allowed to retract a bid within 1 hour of bidding for exceptional circumstances ONLY. Bidder must contact seller with exceptional circumstances immediately at 765-674-3394 during normal business hours. 6.- Trade In Policy: We will always except a trade of your current vehicle. This can be done in two ways. 1.- Bring your vehicle into Mike Anderson Dodge at 3527 S Western Ave, Marion, Indiana 46953 and receive a fair estimate of the true value of your vehicle. 2.- Due to the distance and inconvenience of coming to us, we may be able to give you a range of values for your vehicle on a “sight unseen” basis. These value ranges are always subject to true appraisals at the time of delivery. 7.- Payment and Financing: At the successful completion of any auction a $200 deposit is expected within 24 hours. This can be handled by any major credit card and becomes a non-refundable partial payment. The balance can be arranged through any one of our many banks, credit unions or Chrysler Financial. We strive to acquire the best rates available, however the lending companies determine the current rates. All credit applications are considered confidential and are retained in a locked area for your protection. Your privacy and satisfaction are our most important concerns. For questions related to pre-approval please contact Rusty Whitton at 765-674-3394. 8.- Inspections: Mike Anderson Dodge has inspected all vehicles (excluding vehicles sold “AS IS”) and performs all safety related repairs. All independent inspections must be requested prior to the end of the auction. All fees for said inspections are the responsibility of the bidder. Mike Anderson Dodge is not responsible for errors or omissions in this or any auction. Bidders are incouraged to inspect vehicles prior to bidding or during normal business hours. 9.- Taxes and Fees: All out of state buyers must pay Indiana sales tax. However, if a seller arranges third party shipping to another state and takes delivery in that state, they are not subject to Indiana tax. Mike Anderson Dodge will provide all buyers who take delivery in the state of Indiana with the documentation and title work necessary to title in their own state upon final settlement. All laws are governed by the state of Indiana and we recommend checking with your Bureau of Motor Vehicles in your state as to the taxation rules and regulations. 10.- Titling: Indiana is a bank retained title state. After applying for your title the BMV will return the title to the lender. While this is normal in most states, there are a very few that do not. A temporary 31 day plate will be issued to you for transporting your vehicle to your state and the titling paperwork will be sent by certified mail, usually within 15 days of the final closing. 11.- Shipping: Mike Anderson Dodge will assist the buyer with transportation as requested, however the buyer is responsible for all fees and any legal aspects arriving from the transportation. The vehicle is considered delivered at the time a third party transportation company takes possession of the sold vehicle. In the event of any accident or injury, the buyer is totally and completely responsible after leaving our facility. We strongly recommend an insured and licensed transportation carrier.
