Heavy Equipment Online sales Terms and Conditions All Trucks and Heavy equipment are sold as is where is with no warranty express or implied under any circumstance. There is also no absolute guarantee at to year, make, and model, running condition, usability or saleability. Buyer/bidder is encouraged to view items prior to bidding. Information on the condition report (if available) is intended as a guide to aid in comparison of the unit being sold against other units of like kind and quality and implies no statement of warranty or guarantee. All information on a condition report is obtained through a visual and aural inspection; there is NO mechanical inspection of components, no pressure tests, no lash or play measurements and no under chassis inspection per se. No one has tried to pump fluid with any pumps or weld with any welder. Units may be turned on to verify if they simply run or not. The term “run” or “runs” means that the engine started and ran in a stationary, no load condition for a short time during the physical inspection. The term “operates” means that the unit moved through a range of motions in a no load condition. Physical damage, (i.e. scratches, dents, etc.) missing knobs or keys, broken mirrors or other items considered normal wear and tear for the age / mileage of the unit may not always be noted. Items listed as dealer only: Vehicles which cannot pass the Texas safety and emissions inspection without extensive repairs will be sold to licensed motor vehicle or trailer dealers only. Buyer’s fees: 6% of the bid price with a minimum of $249.50 and a maximum of $1000.00 will be assessed on all units. All PHH fleet leasing vehicles will carry an additional $35.00 PHH buyer’s fee in addition to the base buyer’s fee. Texas Residents: Taxes: All vehicles sold from us will include a motor vehicle inventory tax of 0.002103%. All other vehicles sold through us will not include this tax. Also, in-state and out-of-state sales will be charged an e-tag fee of $5. Titled trailers and Motor vehicles: State law required us to transfer title into the buyers name and collect from the buyer all associated fees and 6.25% Vehicle Sales Tax. The only exemption from this is if the buyer is a registered Texas Motor Vehicle dealer with a valid license and bond. We must have a current license and bond copy on file before any fees or taxes may be overridden. Non titled machinery: State law requires 8.25% State sales (this also includes salvage title vehicles) and Use Tax be collected at time of sale unless buyer has a Resale Exemption form and sales Tax and Use Permit, a 501C3 letter of exemption, or Gasoline Tax exemption form for farm use. Associated fees: $75.00 documentary fee applies to all titles / units, BOS units are exempt. $33.00 title application fee on all titled units. $**** State License plate fee—varies by weight of unit. $5.00 E-Tag fee. $2.00 title verification fee. State Inspection: Vehicles which have non Texas titles or were titled in Texas counties not subject to emissions testing must be re-inspected before title can be processed for sale to an individual... $75.00 re-inspection fee applies to all units needing State Inspection. This fee may not apply to units being sold to dealers. Payment terms and conditions: Dealers: Dealers who are known to Houston Auto Auction and have valid current open accounts will be sold in accordance to their individual dealer profile requirements.
