The following terms of sale apply to all of our auctions.Payment Terms:The successful high bidder will be required to submit a $500 non-refundable deposit within 48 hours of the close of the auction to secure the vehicle. The vehicle will remain available for purchase until the deposit has been secured. Buyer agrees to pay remaining balance due (plus applicable fees and taxes) within 5 business days of the close of the auction. All financial transactions must be completed to our satisfaction before delivery of the vehicle. * PAYMENT and PAPERWORK * All vehicles must be paid for in full before the vehicle will be released. Valid forms of payment are cash (green cash in person), personal checks, bank cashier's checks, bank wired funds, or arranged financing. If payment is made by personal check, the title cannot be released until we receive proof the funds have cleared. All out of state transactions must be paid for by bank cashier's check, wired funds, or arranged financing. This is to assure prompt processing of title work. Buyers must pay our documentation fee of $55. This charge represents cost to the dealer for items such as inspection and preparing documents related to the sale of the automobile. All paperwork must be completed before the vehicle will be released. This includes contracts, DMV paperwork, and miscellaneous dealership forms. The state of California requires us to collect a legible copy of a driver's license for each person on the sales contract and a copy of a valid insurance card. Because of the new Federal Trade Commission Red Flag laws concerning identity theft (16 CFR * 681.2(d)), and existing Homeland Security regulations (Executive Order 13224), we are also required to collect a full customer statement, which includes a credit check. Even though you may be paying cash for the vehicle, we still need to gather this information to comply with these laws and regulations. Collection of these documents and information are for compliance of state and federal laws and are not negotiable. * SALES TAX and REGISTRATION We are a licensed dealer in the state of California and must collect sales tax, registration fees, and transfer titles to new owners according to California law. California residents (and out of state buyers who take possession of a vehicle in California) must pay us all applicable California sales tax and license fees. Vehicles that are shipped to out of state, buyers are responsible for their own taxes and license fees in their own state. That is, unless, the vehicle is being financed, then we are required to guarantee to the lien holder that the sales tax and registration is paid, and therefore will collect and handle the registration of the vehicle in your state. Californialaw requires that license plates on vehicles shipped out of state are removed and returned to the California Department of Motor Vehicles. It is immaterial that the contract of sale may have called for the shipment by the retailer of the property to a point outside this state, or that the property was made to specifications for out-of-state jobs, that prices were quoted including transportation charges to out-of-state points, or that the goods are delivered to the purchaser in this state via a route a portion of which is outside this state. Regardless of the documentary evidence held by the retailer (see (3)(D) below) to show delivery of the property was made to a carrier for shipment to a point outside the state, tax will apply if the property is diverted in transit to the purchaser or his representative in this state, or for any other reason it is not delivered outside this state. (B) Shipments Outside The State - When Sales Tax Does Not Apply. Sales tax does not apply when the property pursuant to the contract of sale, is required to be shipped and is shipped to a point outside this state by the retailer, by means of: 1. Facilities operated by the retailer or 2. Delivery by the retailer to a carrier, customs broker or forwarding agent, whether hired by the purchaser or not, for shipment to such out-of-state point. The term “forwarding agent” means a person or firm regularly engaged in the business of preparing property for shipment or arranging for its shipment. An individual or firm not otherwise so engaged does not become a “carrier” or “forwarding agent” within the meaning of this regulation simply by being designated by a purchaser to receive and ship goods to a point outside this state. Buyer agrees to pay remaining balance due (plus applicable fees and taxes) within 5 business days of the close of the auction. All financial transactions must be completed to our satisfaction before delivery of the vehicle.
* PAYMENT and PAPERWORK *
All vehicles must be paid for in full before the vehicle will be released. Valid forms of payment are cash (green cash in person), personal checks, bank cashier's checks, bank wired funds, or arranged financing.
If payment is made by personal check, the title cannot be released until we receive proof the funds have cleared.
All out of state transactions must be paid for by bank cashier's check, wired funds, or arranged financing. This is to assure prompt processing of title work.
Buyers must pay our documentation fee of $55. This charge represents cost to the dealer for items such as inspection and preparing documents related to the sale of the automobile.
All paperwork must be completed before the vehicle will be released. This includes contracts, DMV paperwork, and miscellaneous dealership forms.
The state of California requires us to collect a legible copy of a driver's license for each person on the sales contract and a copy of a valid insurance card.
Because of the new Federal Trade Commission Red Flag laws concerning identity theft (16 CFR * 681.2(d)), and existing Homeland Security regulations (Executive Order 13224), we are also required to collect a full customer statement, which includes a credit check. Even though you may be paying cash for the vehicle, we still need to gather this information to comply with these laws and regulations. Collection of these documents and information are for compliance of state and federal laws and are not negotiable.
* SALES TAX and REGISTRATION
We are a licensed dealer in the state of California and must collect sales tax, registration fees, and transfer titles to new owners according to California law.
California residents (and out of state buyers who take possession of a vehicle in California) must pay us all applicable California sales tax and license fees. Vehicles that are shipped to out of state, buyers are responsible for their own taxes and license fees in their own state. That is, unless, the vehicle is being financed, then we are required to guarantee to the lien holder that the sales tax and registration is paid, and therefore will collect and handle the registration of the vehicle in your state.
Californialaw requires that license plates on vehicles shipped out of state are removed and returned to the California Department of Motor Vehicles. It is advised that you contact your local DMV for a temporary registration while your title work is in process.
* SHIPPING OF VEHICLES
Although we will make all efforts to assist you in having your vehicle shipped to you if you so choose, we are not in the shipping business and can not guarantee shipping costs and timetables. We will gladly assist you in locating a shipper with proven reliability and competitive pricing. However, we do not act as their agents and cannot be held accountable for their services.

In order to make your out of area vehicle purchase as smooth as possible, here is an outline of our sales and delivery procedures. Please read and email back that you have read and understand the procedure.
Even though some of these steps may not apply to your sale, you’ll have fun reading them none the less.
- Price & Terms are agreed upon
- A deposit is secured and a form (used for both financing and cash deals) is sent to you and returned to us by email.
- The vehicle is then considered to be “sold, and documents in transit”
- Sales documents will be fed-ex’d to you (for cash deals) or to a local notary service (for financed deals). Going to your bank or credit union, getting a loan, and sending us a check is still “financing”.
- Once all documents and monies are received and cleared, the vehicle will be available to be picked up or shipped, as allowed byCalifornialaw.
- If we are helping to arrange shipment of the vehicle, we will not begin the process until all paperwork is received and verified, and all monies are cleared.
- Vehicles are typically picked up between a week and ten days from the day the process begins, and then take an appropriate time based on distance and weather conditions.
- All shippers we work with are insured and licensed.
- Shippers are independent contractors and we assume no responsibility for them
- Shipping damage though rare, is the responsibility of the shipper. Be sure to properly inspect your vehicle once it arrives. If there is damage, ask the shipper how to file a claim.
Once all paperwork and monies are received and cleared, we will begin the titling and registration process.
- If you are financing your vehicle, we as the dealer are responsible to the lien holder (bank or credit union) to make sure the vehicle is registered properly. We will send your information to the proper DMV department in your area via a third party registration company. You are STRONGLY advised to contact your local DMV to see if a temporary registration is available for your new vehicle.
- Different states require different documentation and (as you already probably know) DMV departments are not the speediest places to do business.
- If you paid “cash” for your vehicle, we will send out the title as soon as we have it in hand.
- “Why might you not have the title?” you ask? A fair question and one that deserves a long and complicated answer.
- If the previous owner (in the case of a pre-owned vehicle) had an unpaid balance on a loan, we are required to pay off the loan and then wait ten days for that payment to “clear” before the lien holder sends us the title. They will then send us the title and we will overnight it to you as soon as we get it.
- In the case of a new vehicle, once it is reported “sold”, DMV will then send us an MSO (manufactures statement of origin) which we then send to our third party registration company (as we register ALL new vehicles)

Regulation 1620. INTERSTATE AND FOREIGN COMMERCE.
(3) SALES PRECEDING MOVEMENT OF GOODS FROM WITHIN STATE TO POINTS OUTSIDE STATE.
(A) To Other States - When Sales Tax Applies. Except as otherwise provided in (B) below, sales tax applies when the property is delivered to the purchaser or the purchaser’s representative in this state, whether or not the disclosed or undisclosed intention of the purchaser is to transport the property to a point outside this state, and whether or not the property is actually so transported. It is immaterial that the contract of sale may have called for the shipment by the retailer of the property to a point outside this state, or that the property was made to specifications for out-of-state jobs, that prices were quoted including transportation charges to out-of-state points, or that the goods are delivered to the purchaser in this state via a route a portion of which is outside this state. Regardless of the documentary evidence held by the retailer (see (3)(D) below) to show delivery of the property was made to a carrier for shipment to a point outside the state, tax will apply if the property is diverted in transit to the purchaser or his representative in this state, or for any other reason it is not delivered outside this state.
(B) Shipments Outside The State - When Sales Tax Does Not Apply. Sales tax does not apply when the property pursuant to the contract of sale, is required to be shipped and is shipped to a point outside this state by the retailer, by means of:
1. Facilities operated by the retailer or
2. Delivery by the retailer to a carrier, customs broker or forwarding agent, whether hired by the purchaser or not, for shipment to such out-of-state point. As used herein the term “carrier” means a person or firm regularly engaged in the business of transporting for compensation tangible personal property owned by other persons, and includes both common and contract carriers. The term “forwarding agent” means a person or firm regularly engaged in the business of preparing property for shipment or arranging for its shipment. An individual or firm not otherwise so engaged does not become a “carrier” or “forwarding agent” within the meaning of this regulation simply by being designated by a purchaser to receive and ship goods to a point outside this state. (This subsection is effective on and after September 19, 1970, with respect to deliveries in California to carriers, etc., hired by the purchasers for shipment to points outside this state that are not in another state or foreign country, e.g., to points in the Pacific Ocean.)
For over 40 years, Tipton Motors has held close to two basic tenets – family and faith. Born on the plains of Texas 93 years ago, H.B. Tipton has seen it all. He survived the Great Depression and World War II. He's seen ups and downs in the economy and has lived through 16 U.S. presidential administrations. When asked what advice he has for this generation his answer is simple – "have a little faith."
H.B. left Texas for California in 1937 with his life savings in his pocket and his faith in his heart. Hard working and dedicated, he worked for the government through WWII and entered the car business in 1947. With a work ethic forged in the Depression, H.B. opened his first dealership in La Jolla and became San Diego's very first Honda Dealer in 1971. Thirty-eight years later, his family's name is still on the building.
Choosing to keep family first, members of the Tipton family have all helped in the success of San Diego's No. 1 Honda store. H.B.'s brother, L.C. – a WW II prisoner of war – joined the staff as a manager. Sons Terry and Tyrone and daughter Tange, have all contributed to four decades of serving San Diego.
